Welcome to the Payment, Cancellation and Refund Policy of Speekl, LLC (collectively referred to as "Speekl", "speekl.com", "we", "our" or "us" in this Payment, Cancellation and Refund Policy). At Speekl, we strive to provide a satisfactory user experience and ensure transparency in our cancellation and refund processes. This Payment, Cancellation and Refund Policy outlines the guidelines and procedures regarding cancellations and refunds for payments made on the services provided by Speekl. These services include, but are not limited to, the Speekl mobile application, Speekl web application, and the web-based tutor panel, collectively referred to as the “Platform.” Please read this Payment, Cancellation and Refund Policy carefully before making any payments, as it determines your rights with regard you your purchases, including essential restrictions and exclusions.

By using and/or ordering services, and/or downloading the Platform, you consent to all actions that we take with this Payment, Cancellation and Refund Policy, and you acknowledge that you have read and agree to be bound by it.

If you disagree with any part of this Payment, Cancellation and Refund Policy, then please do not use the Platform.

  1. Definitions

    Speekl (also referred to as "speekl.com", "we", "our" or "us") — Speekl, LLC, a limited liability company registered and organized under the laws of the State of Delaware and having its registered office at 1111b South Governors Ave, STE 7418, Dover, DE 19904, USA.

    Platform — online language learning platform developed by Speekl, which facilitates the language learning process between Students and Tutors, including but not limited to the Speekl mobile application, Speekl web application and the web-based tutor panel.

    Websites — Speekl’s websites, including but not limited to website located at speekl.com, and its sub-domains.

    Student — a user that purchases Tutoring Services by using the Platform.

    Tutor — a user that provides Tutoring Services by using the Platform.

    Tutoring Services — all tutoring services provided by a Tutor to the Students, including but not limited to paid lessons, packages and other online language tutoring services by using the Platform.

    Lesson — a paid instructional session conducted between a Tutor and a Student through the Platform.

    Speekl Classroom — a video conferencing tool, allowing Students and Tutors to meet each other and conduct Lessons virtually - either by video or audio-only or both.

    User (also referred to as “you”) — any individual accessing or utilizing the services and functionalities offered by the Platform, including but not limited to Students and Tutors.

  2. Billing Currency

    Payment transactions are processed in USD currency, and the prices displayed are also in USD. Please note that if your payment method's billing currency differs from USD, your payment may be processed outside of your country of residence.

    Consequently, certain fees, such as international transaction fees and foreign exchange fees, may apply, and the amount reflected on your bank statement may vary from the amount shown at checkout.

    Speekl shall not be responsible for any such fees and currency fluctuations and Speekl hereby disclaims all liability in that regard.

    If you have any inquiries about the fees or applicable exchange rates, we recommend contacting your bank or credit card company for further clarification.

  3. Payments

    The Platform accepts various online payment methods to provide convenience and flexibility. At the moment, we support the following payment methods:

    • Debit/Credit Card;
    • Apple Pay;
    • Google Pay.

    Please note that all payments for the use of the Platform and utilizing the Tutoring Services must be processed exclusively through the Platform.

    It is important to ensure that the payment information provided is accurate and up to date to avoid any payment processing issues. By using the Platform and making payments, you acknowledge that you have the necessary authorization to use the selected payment method.

  4. Chargebacks

    If a chargeback is initiated by your bank or a third-party payment provider regarding your purchase of any Lesson, you acknowledge and agree that we reserve the right to temporarily suspend access to all your accounts with us.

    You are responsible for any fees and expenses incurred as a result of chargebacks or other payment disputes initiated by you, your bank, or a third-party payment provider.

  5. Payment Services Providers

    The Platform is integrated with Stripe, an online payment processing platform. Payment processing in the Platform is provided by integrated iframe for checkouts from Stripe, allowing Students to securely and efficiently make payments for their Lessons.

    It is important to note that the Speekl and the Platform do not have access to or store any of the User's payment details, as Stripe allows the Platform to bill the Students through integrated iframe for checkouts instead of directly processing the User's payment details. All transactions are secured as third-party payment provider Stripe uses SSL encryption protection.

    By using the Platform to make payments for Lessons, you acknowledge and comprehend that your billing information is exclusively handled by third-party payment provider Stripe. Speekl and the Platform do not collect, store, or engage in any other processing of your billing information.

    You acknowledge and accept that Speekl holds no responsibility for any inadequacies in the third-party's protection of such information. The processing of payments will be governed by the terms, conditions, and privacy policies of the third-party payment provider Stripe, in addition to the provisions outlined in this Payment, Cancellation and Refund Policy.

    Please note that when purchasing a Lesson, the transaction includes Stripe fees. These fees are an integral part of ensuring secure and efficient transactions within the Platform. Stripe fees are determined based on the transaction amount. For detailed information on how these fees are calculated, please refer to the Stripe Pricing & Fees section at https://stripe.com/pricing.

    You acknowledge that we reserve the right to change third-party payment provider(s) and may require them to transfer your information to other service providers who utilize secure socket layer technology (SSL) or other equivalent security measures to encrypt your information.

  6. Lesson Rescheduling

    Within the Platform, Students have the flexibility to reschedule their Lessons at their discretion, regardless of the Lesson's date, price, or other factors.

    To initiate the rescheduling of a scheduled Lesson, Students can use the 'Reschedule' button provided within each of their booked Lessons. Depending on the timing of the rescheduling, the following policies apply:

    • Advance Rescheduling: Students are able to reschedule Lessons up to 6 hours before the scheduled start time to another suitable date and time.
    • Late Rescheduling: Students are not permitted to reschedule Lessons within the last 6 hours before the scheduled start time. In such cases, if Students cannot attend the Lesson, we recommend canceling the Lesson.

    This rescheduling feature empowers Students to effectively manage their scheduled Lessons, maintaining control over their bookings.

  7. Lesson Cancellation

    Within the Platform, Students have the flexibility to cancel their Lessons at their discretion, regardless of the Lesson's date, price, or other factors.

    To initiate the cancellation of a scheduled Lesson, Students can use the 'Cancel' button provided within each of their booked Lessons. Depending on the timing of the cancellation, the following policies apply:

    • Advance Cancellation: Cancellations made up to 6 hours before the scheduled start time entitle Students to a full refund without incurring any additional charges.
    • Late Cancellation: Cancellations made within the last 6 hours before the scheduled start time fall into the category of late cancellations. In such cases, no refund will be provided, and the full cost of the Lesson will be charged to the Student.

    This cancellation feature empowers Students to manage their scheduled Lessons effectively while ensuring that Tutors do not possess the authority to cancel Lessons, maintaining Students' control over their bookings.

  8. Refund

    • Lesson Cancellations: If you initiate a Lesson cancellation up to 6 hours prior to the scheduled start time, you will be eligible for a refund. If you initiate a Lesson cancellation within the last 6 hours before the scheduled start time, no refund will be provided, and the full cost of the Lesson will be charged to the Student.
    • Student Lateness: If you arrive late to the Lesson, but within a maximum delay of 15 minutes, you are not eligible for a refund. The Lesson will proceed for the remaining duration as scheduled.
    • Tutor Lateness: If the Tutor arrives late to the Lesson, with a delay of no more than 5 minutes, the Tutor will extend the Lesson's duration by the equivalent amount to maintain the full 55-minute Lesson.
    • Student No-Showing: If you fail to attend the Lesson and do not participate within the first 15 minutes, the Lesson will be automatically cancelled, and you will not be eligible for a refund.
    • Tutor No-Showing: If the Tutor exceeds a 5-minute delay, the Lesson will be automatically cancelled. In such cases, you will have the choice to reschedule the Lesson or request a refund.
    • Technical Issues: Should you encounter any technical difficulties during a Lesson, please promptly notify us. We will thoroughly investigate the issue and assess its validity. Depending on the circumstances, we may offer to reschedule the Lesson or provide a refund.

    Please note that all refund requests will be evaluated on a case-by-case basis, and our decision will be based on the specific circumstances and adherence to the outlined Payment, Cancellation and Refund Policy.

  9. Refund Process

    If you wish to request a refund, excluding refunds for advance cancellations which are processed automatically, please send an email to hello@speekl.com. In your email, please provide the following details:

    • Your full name;
    • Tutor's name;
    • Date and time of the Lesson;
    • Reason for the requested refund.

    Our customer support team will carefully evaluate your request and render a refund decision within 20 calendar days. If your refund is approved, it will be processed using the original payment method.

    The refund option is available for a period of 90 days from the date of your payment. After this time, refund requests will not be entertained. Please note that only one refund can be issued per request.

    It is important to understand that any refunds, at any given time, are subject to our sole discretion, to the fullest extent permitted by law.

  10. Refund Terms and Financial Disclaimer

    The speed and availability of refunded funds in your bank account are subject to the terms and policies of your bank. The precise refund amount will be based on the exchange rate between USD currency and your payment method's currency, as determined at the time the refund is initiated. When a refund has been issued by Speekl, it typically takes approximately 10 days to reflect on your statement. If it takes longer, we recommend contacting your bank for assistance.

    Please be aware that Speekl is not responsible for any fees charged by banks or third-party payment providers, and we will not cover such fees when processing a refund.

    It is important to note that Speekl is not a financial institution and does not provide any financial services or advice. Payments made through the Platform are solely for the purpose of facilitating the access and delivery of Tutoring Services between Students and Tutors. It is strictly prohibited to use these payments for any fraudulent, criminal, or illegal activities as defined by law.

  11. International

    This English-language Payment, Cancellation and Refund Policy is Speekl official statement of the Platform payment, cancellation and refund practices. In case of any inconsistency between this English-language Payment, Cancellation and Refund Policy and its translation into another language, this English-language document prevails.

  12. Updates to the Payment, Cancellation and Refund Policy

    We keep our Payment, Cancellation and Refund Policy under regular review. This version was last updated on 15 February 2024.

    We may change our Payment, Cancellation and Refund Policy, so please check this page from time to time, as your continued use of the Platform, after we publish our changes, indicates your acceptance of any changed terms.
